State Requirements

In order to sell scrap metal, sellers will be required to:

  • Allow a copy of the seller’s a driver’s license or state ID card;
  • Sign a statement indicating that they are the owner of or are authorized to sell the metal;
  • Sign a statement that they have not been convicted of metal theft.

Buyer’s must:

  • Record make, model and license plate number of sellers vehicle used to transport scrap
  • ***Keep a record of sellers name, address, drivers license number, type of metal and date of sale
  • All sales tickets must have location of sale, date and time of the sale, as well as the initials of the clerk completing the sale.
    • Must also show the weight, quantity and/or volume, and price paid for the material.
    • Sales tickets must be signed by the seller.  Seller will receive a copy of the receipt and buyer will retain a copy.

         ·            Buyer must report purchased vehicle information to NMVTIS

         ·            Tag and hold policies are in effect (up to 3 days)

NOTE:  Please be aware of your local ordinances.  Many cities and counties have additional ordinances that may not be listed here.

***All scrap metal dealers must register with the Office of Occupations and Professions.

All payments must be made by check payable to the seller and be mailed to the sellers address (PO boxes are not acceptable) after a one day holding period.

***A daily log of all transactions must be retained in KRS and purchaces of restricted metals must be reported to the State Police.

It is unlawful to purchase materials from persons under the age of 18.

Keep records, certifications, registrations, etc. on site for 2 years. 

Scrap recyclers must maintain a record of all purchases for a minimum of two years and is subject to inspection by any law enforcement at any time. There is a 3-day tag-and-hold policy when notified by law enforcement to do so.

***A title or salvage title must be presented with the purchase of any vehicle.

No scrap metal business may purchase or receive beer kegs from anyone except a distributor or manufacturer of beer kegs or licensed brewery.

It is unlawful to purchase any restricted metal, burned wire, or smelted metal unless the seller can provide written proof or current licensure that they are the lawful owner of the property and have the right to sell such property.

No scrap metal business may enter into a transaction to purchase or receive any metal or metallic wire that was burned in whole or in part to remove insulation unless the seller can produce written proof to the scrap metal business that the wire was lawfully burned or lawfully recovered from a burned structure.

All purchases of restricted metals must be reported by the end of the business day to local law enforcement, including all purchases of copper and copper wire.
