Legal Mandates Indiana

State Requirements

In order to sell scrap metal, sellers will be required to:

  • Allow a copy of the seller’s a driver’s license or state ID card (obtained at the first sale, all other sales can reference license/ID on file)
  • Sign a statement indicating that they are the owner of or are authorized to sell the metal;
  • Sign a statement that they have not been convicted of metal theft which includes the statement “I, the undersigned, affirm under penalty of law that the property that is subject to this transaction is not to the best of my knowledge stolen property.”

Buyer’s must:

  • Record issuing state and license plate number of sellers vehicle used to transport scrap
  • Keep a record of sellers name, address and date of sale
  • A video or photograph of the seller and the material being sold.
  • All sales tickets must have:
    • Name and address of dealer;
      •  Date and time and place of sale, as well as the initials of the clerk completing the sale.
    • Must have a description of the material, show the weight, quantity and/or volume of the material.
    • Must have price paid for the metal.
    • Description of the source of the metal (where the metal was obtained).
    • Sales tickets must be signed by the seller.  Seller will receive a copy of the receipt and buyer will retain a copy.

         ·            Buyer must report purchased vehicle information to NMVTIS

         ·            Tag and hold policies are in effect for a minimum of 5 days.

NOTE:  Please be aware of your local ordinances.  Many cities and counties have additional ordinances that may not be listed here.

Keep records, certifications, registrations, etc. on site for 2 years. 

Scrap recyclers must maintain a record of all purchases for a minimum of two years and is subject to inspection by any law enforcement at any time. There is a tag-and-hold policy on all material for a minimum of 5 working days when notified by law enforcement to do so.

No scrap metal business may purchase or receive beer kegs from anyone except a distributor or manufacturer of beer kegs or licensed brewery.

***It is unlawful to purchase air conditioner coils from anyone who cannot show that they are licensed to receive/sell such material. (Entire window air conditioning units are exempt from this rule.)

***It is unlawful to purchase catalytic converters unless they are part of a whole vehicle, unless the seller has the title, registration and/or a receipt for repair for the unit, or the seller is an authorized automobile dealer.
