State Requirements

In order to sell scrap metal, sellers will be required to: 

  •  Allow a copy of the seller’s a driver’s license or state ID card (this only needs to be collected at the first sale, additional sales can refer to the ID on file);
  • Sign a statement indicating that they are the owner of or are authorized to sell the metal;
  • Sign a statement that they have not been convicted of metal theft; 
  • Provide a fingerprint to be kept on file

Buyer’s must:

  • Record issuing state and license plate number, color and make of sellers vehicle used to transport scrap
  • Keep a record of sellers name, address and date of sale
  • All sales tickets for purchases over the amount of $50 must have location of sale, date and time of the sale, as well as the name of the clerk completing the sale. (With the exception of catalytic converters, which require all following information regardless of sales price).
    • Must also show the weight, quantity and/or volume and description of the material.
    • Sales tickets must show the amount paid to the seller.
    • Sales tickets must be signed by the seller.  Seller will receive a copy of the receipt and buyer will retain a copy.

         ·            Buyer must report purchased vehicle information to NMVTIS

o   Vehicle VIN #, make, model, and description must be kept on file for all scrap automobiles and/or vehicle parts.

         ·            Tag and hold policy is in effect (for a minimum of 33 days)

NOTE:  Please be aware of your local ordinances.  Many cities and counties have additional ordinances that may not be listed here.

***All scrap metal dealers must register with the city or county in which they are located.

Keep records, certifications, registrations, etc. on site for 2 years. 

Scrap recyclers must maintain a record of all purchases for a minimum of two years and is subject to inspection by any law enforcement at any time. There is a tag-and-hold policy for a minimum of 33 working days when notified by law enforcement to do so.

It is unlawful to purchase any metal or copper wire that has been burned, melted or smelted unless they sign a waiver saying they are the true owner of the material and is entitled to sell it.

It is unlawful to purchase any of the following materials without written proof including licensure to sell said items:  utility access covers, street light poles or fixtures, guard rails, street signs, water meter covers, traffic lights, any metal marked with the name of a government, utility, school or other entity, railroad spikes or rails, funeral markers, historical markers, beer kegs, fire hydrants, junk vehicles with missing VIN, real estate signs, bleachers or risers, or telecommunication wire.

Any purchases of catalytic converters that have been separated from a vehicle, air conditioner coils or condensers, and/or copper tubing or sheeting must be paid for with check made payable to the seller or if paid in cash the transaction must be videotaped and held in records for a period of 2 years.

It is unlawful to purchase scrap metal from a minor (under 18 years old) without a parent/guardian present, or whose parent/guardian has been convicted of a felony.

It is unlawful to purchase scrap metal from a person who has been convicted of a felony in the past 5 years.
